You have in all likelihood, heard of the term but you may not be aware as to what exactly it is. Below is a brief FAQ as to what it is, how it works and by when should you contact us to make a claim

What is a CFA?

A Conditional Fee Agreement, more commonly referred to as a No Win, No Fee Agreement is a legally binding funding arrangement between you, our client, and us whereby the success fee payable to us is conditional upon the conclusion of your case. Effectively, this means if you lose your case, you do not have to pay us for any legal work done. If you win, then you pay us our legal costs and a success fee. The success fee paid to us is capped at 25% from the total amount of damages/compensation awarded to you.

So how does a CFA benefit me?

Entering into a CFA with us for all your personal injury matters is beneficial to both you and us. A CFA is only entered into if we believe your case has a strong chance to be successful thereby providing security and reassurance in knowing that whatever claims you bring forward, we will evaluate it critically and with your interests in mind before proceeding. In the event of a successful claim, all fees are effectively paid for thanks to the compensation pay-out. In an unsuccessful claim, you don’t need to pay for our legal fees. In either event, you are bearing zero to minimal financial risk in pursuing a case but with the risk of attaining significant financial rewards.

What will I be awarded if I win?

Monetary compensation, better known as damages, are awarded to you in the event of a successful claim. In such instance, there are 2 forms of damages you could be entitled to –

General damages – these are damages which are awarded for any pain, suffering or loss of amenity you suffer in the aftermath of an accident. Due to the subjective nature of these losses, these aren’t as easy to quantify so the amount you can recover for this type is dealt with on a case-by-case basis. Damages which can be categorised as general damages include whiplash, emotional distress, suffering mental health issues as a result, impact of shock suffered and trauma. To reiterate, each case will assess the merits of general damages to be awarded on its own basis

Special damages – these are damages which are much more quantifiable in contrast with general damages i.e. a monetary value can be placed on your losses. Examples of special damages which you can claim for include rehabilitation costs, travelling costs, costs to repair any damage to your vehicle or property, loss of earnings due to not being able to work, and costs for treatment.

So when do I make a claim by?

Personal injury claims are subject to a period of limitation. This means that legally, a claim has to be made by you within 3 years from the date of the incident otherwise, any claims after the period will be considered expired.
