VISA APPLICATIONS
Bail
A bail case and their typical timescales can vary depending on specific circumstances of the case.
Usually soon after the applicant being detained and dependant on how long he has been in the UK and if he has applied for bail I the last 28 days and been refused he can apply for bail which can take usually around 24-48 hours. (Dependant on receiving the relevant documents from the client).
Timescale – Within 2 working days a bail hearing will be scheduled and a decision is made on the day.
Legal fees- £600 plus disbursements*
Appeal
An applicant within the UK usually has 14 days to lodge the appeal. (out of country 28 days).
Within a few weeks of receiving the appeal the tribunal acknowledge and review the appeal.
Typically within 28 days the respondent is notified of the appeal and is asked to provide a response including their evidence and reason for decision.
After the response from the respondent the tribunal issue directions to both parties outlining the steps to be taken before the actual hearing.
Both parties prepare for the hearing, gathering evidence, preparing witness statement. This can take several weeks to several months depending on the complexity of the case
The hearing takes place once all the above has been complete and the tribunal provide both parties with the hearing date where they present their case and submit their evidence,
Timescale – After the hearing the decision is usually provided within a few weeks of the hearing.
£2500-£7000 plus disbursements*
Counsel fees: £500-£100.
Deportations
An appeal is filed against the deportation decision, this is usually done within 14 days if in the UK and 28 days if outside of the UK.
The tribunal acknowledges and reviews the appeal. (2-3 weeks of receiving the appeal)
The tribunal issue directions to both parties outlining the step to be taken before the hearing. Directions are usually issued within a few weeks after the appeal.
Preparation of hearing – can take several weeks to several months.
Hearing is usually scheduled 6-8 months after the appeal being lodged and the hearing itself lasts only a few hours.
Timescale- A decision is usually provided by writing a few weeks after the hearing.
£2500-£5000 plus disbursements*
Revocation of visa
Usually have 14 days if within the UK and 28 days if outside of the UK to provide grounds.
Timescale- A decision usually takes around 3-6 months.
£1200-£2000
Entry Clearance application
Dependant on all documents being provided an application for entry clearance can be completed within a few days.
The applicant pays the visa fee and books an appointment to provide biometric information.
The applicant submits the supporting documents prior to the biometric appointment.
Th standard processing times for an entry clearance application is around 3 months however priority and super priority applications are available on some applications.
If the application is successful, the applicant is required to come within 28 days and thereafter receive their biometric card within 10 working days from the local designated post office.
Timescale- 3 months from the date of biometric appointment.
Legal fees – £900-£1500
Spouse extension
The applicant has to evidence that they meet the requirements under Appendix FM to be granted leave to remain under the spouse route.
Timecales- Processing time around 2-3 months. However, priority and super priority service is also available.
Legal fees- £950-1500
Indefinite Leave to Remain
If the applicant meets the rules of Indefinite Leave to Remain an application can be submitted before the expiry of the applicant’s current visa.
Timescales- Once the application is submitted and biometric information provided, the standard processing time for ILR applications is up to 6 months.
Legal fees- £950-1500
Citizenship
After submission a decision is usually made within 6 months. Thereafter you will be invited to a citizenship ceremony through your local council.
Timescale- 3 months
Legal fees – £600-£1000
Asylum
Asylum is usually submitted upon arrival to the UK or shortly after.
Client will then undergo a preliminary screening interview to collect basic information, this is usually done within a few weeks of claiming asylum. Client will also provide biometric information on this day.
Client will then attend a substantive interview thereafter wait or a decision. A decision typically ranged from a few months to over a year, depending on the complexity of the case.
Timescale – this depends on each individual case however a decision can take around 12 months or more.
Legal fees – £1500-£6000
Visit Visas
Once the relevant documentation is collated from the applicant and sponsor, the application is submitted along with book a biometric appointment in the applicant’s home country.
Timescale- A decision is usually made within 3 weeks.
Legal fees- £750 – £1200
Domestic violence application
Applicants are only entitled to submit this application if they initially came to the UK as the spouse of a British citizen/settled person in the UK.
Timescale- Should the applicant meet the requirements and have the relevant documentation an application can be submitted with a decision usually being made within 6 months.
Legal fees- £900 – £1500
Right of Abode
Gather the necessary documents to support application. This will include evidence of you being a child of a parent who is a British citizen or a citizen of a commonwealth country with the right of abode.
Timescale- A decision is usually made within 6 month.
Legal fees- £900-£1200
Judicial Reviews
Judicial review is where a court reviews the lawfulness of a decision.
Before starting a judicial review, the client must submit a pre action protocol. The client should wait 14 days for a response.
If the matter Is not resolved the client will then file a claim for judicial review in court.
If permission is granted in court both parties prepare for the oral hearing.
Timescale- The process for a Judicial Review can take several months.
Legal fees – £2000-£7000
UK Ancestry
This visa allows commonwealth citizens to live and work in the UK, if they have a grandparent born in the UK.
A decision is usually made within 3 weeks however this is dependant on the complexity of the case.
Legal fees- £1000-1500
EU applications
EU applications offer broad visa types dependant on which visa category you meet.
This can be pre settled, settled or an EU Family Permit. This is all dependant on if the requirements are met, given the fact that the main eligibility under this route would need to evidence that the applicant/sponsor has been residing in the UK by 31 December 2020.
Timescale- Given the huge backlog of EU applications, the process times for majority of applications under this route can take up to 12 months.
Legal fees – £750-£1500
Skilled worker visa applications
The applicant must have a licensed sponsor and issue you with a Certificate of Sponsorship (Cos) along with the remainder of the eligibility requirements under this visa route.
Timescale– it can take up to 8 weeks for the employer to provide the CoS.
If the applicant submits the application from outside the UK, it takes around 3 weeks. If the applicant submits inside the UK, it takes around 8 weeks for a decision on the application.
Legal Fees: £1200-£1500
Certificate of Sponsorship
The applicant must provide evidence that they are a legitimate organisation and have the appropriate HR systems in lace to manage sponsored employees. The application will involve submitting various documents and paying the required fee.
Once the licence is granted, the employer can request a CoS through the online system. There are two types od CoS: Defined CoS (for applicants outside the UK) and Undefined CoS (applicants inside the UK).
Timescale: The current processing time is approximately 8 weeks.
Legal Fees: £1800-4000
Short term study visa
The applicant will be required to enrol on a short-term English course lasting between 6-11 months. It is imperative that the college the applicant enrols with is a recognised and accredited organisation.
Timescales: Current processing time is approximately 4-6 weeks from the date of the applicant’s biometric appointment
Legal fees: £900-£1200
DISBURSEMENTS
Court fee: £140.00
Interpreter fee: approximately £30 per hour
Counsels fee: £300-£1000.
*Timescale to submit application: Applications from date of instruction can take up to six – eight weeks on average depending on complexity of applicant’s immigration history and dependant on when the applicant provides the requisite documents. We will let you know at the earliest opportunity if it is likely to take longer than this.
*Timescale on return of application submitted: We cannot guarantee how long the Home Office will take to process your application, this is dependant on the type of application, complexity of the application and the Home Office’s current processing time on each application.
